USCIS Policy Update: Special Immigrant Juvenile (SIJ) Petition Filing Procedures


WAHSINGTON, DC- We are updating the USCIS Policy Manual to clarify how certain petitioners for special immigrant juvenile (SIJ) classification (or their representatives) may file Form I-360, Petition for Amerasian, Widower, or Special Immigrant.

Key Changes:
1- In-Person Filing Option:
• Eligibility: SIJ petitioners within two weeks of their 21st birthday.

• Procedure: Eligible petitioners may file Form I-360 in person at a USCIS field office.
Action Required: Contact the USCIS Contact Center to request an expedited appointment.

2- Mail Filing:
• Eligibility: SIJ petitioners not within two weeks of their 21st birthday.

• Procedure: Continue to file Form I-360 by mail, following current filing instructions.
Children eligible for SIJ classification must file their petition by their 21st birthday. Many face challenges in filing on time due to juvenile court delays or other circumstances. Allowing SIJ petitioners to file in person provides an alternative to ensure timely receipt of their petition.

•Effective Date: This policy was initiated on March 30, 2023.

• Manual Update: The USCIS Policy Manual is being updated for transparency and consistency.
