WASHINGTON , DC- The U.S. Citizenship and Immigration Services (USCIS) has completed the initial electronic registration selection process for the fiscal year 2024 H-1B numerical allocations. The USCIS has received enough electronic registrations to reach the cap and has notified the selected petitioners that they are eligible to file an H-1B cap-subject petition for the beneficiary named in the selected registration. The status of each registration can be viewed on the registrant’s online account, and it will show either “Submitted,” “Selected,” “Denied,” or “Invalidated-Failed Payment.”

H-1B cap-subject petitions for FY 2024 can be filed with USCIS starting April 1, 2023, but only if based on a valid, selected registration. Only petitioners with selected registrations can file H-1B cap-subject petitions, and only for the beneficiary named in the selected registration notice. The H-1B cap-subject petition must be properly filed by paper within the 90-day filing period indicated on the registration selection notice.

The USCIS will not be using prepaid mailers to send out any communication or final notices for FY 2024 cap-subject H-1B petitions. The USCIS will use first-class mail to process all cap-subject petitions in a timely manner.

When a timely and properly filed H-1B cap-subject petition is received by USCIS, the petitioner will receive a Form I-797, Notice of Action, confirming receipt of the petition. However, due to increased filing volumes during the H-1B cap filing periods, there may be delays in issuing the Form I-797. If more than 30 days have passed since the confirmation of delivery and the Form I-797 has not been received, the petitioner may contact the USCIS Contact Center for assistance.
